This Privacy Policy explains how we collect, hold, use, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy should be read together with our Terms and Conditions of Sale, Returns and Refunds Policy, and Delivery Policy, all available at www.elevatesurvey.com.au.

  1. About This Policy (APP 1)

This Privacy Policy sets out how we manage your personal information in an open and transparent manner. It describes the kinds of personal information we collect, how and why we collect it, who we may share it with, and how you can access, correct, or make a complaint about the handling of your personal information.

We review this policy regularly to ensure it remains current, accurate, and compliant with Australian privacy law.

  1. What Is Personal Information

Under the Privacy Act, personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether recorded in a material form or not.

  1. Information We Collect (APP 3)

We collect only the personal information that is reasonably necessary for, or directly related to, our business functions and activities. The types of personal information we may collect include:

3.1 Information You Provide Directly

  • name, email address, telephone number, and company name;
  • delivery address and billing address;
  • payment information (processed securely by third-party payment gateways — we do not store credit card numbers on our systems);
  • account registration details and order history;
  • information provided in credit account applications, including ABN, director details, trade references, and financial information;
  • correspondence, feedback, reviews, or comments you send to us; and
  • any other information you voluntarily provide to us.

3.2 Information Collected Automatically

  • IP address and browser type;
  • device information (operating system, screen resolution);
  • pages visited, time spent on pages, and navigation patterns on our website;
  • referring website or search terms used to find our website; and
  • cookie data and similar tracking technologies (see section 8 below).

3.3 Sensitive Information

We do not generally collect sensitive information (as defined under the Privacy Act) such as health information, racial or ethnic origin, political opinions, or religious beliefs. If we ever need to collect sensitive information, we will obtain your explicit consent and only collect what is strictly necessary.

  1. How We Collect Information (APP 3, APP 5)

We collect personal information:

  • directly from you when you place an order, create an account, apply for a credit account, contact us, or subscribe to our communications;
  • from your use of our website through cookies and similar technologies;
  • from third parties such as credit reporting agencies (for credit account applications), our delivery partners, and our payment processors; and
  • from publicly available sources where necessary and lawful.

Where reasonably practicable, we will collect personal information directly from you. We will notify you at or before the time of collection about the purposes of collection, as required by APP 5.

  1. Why We Collect, Use and Disclose Information (APP 6)

We collect, hold, use, and disclose your personal information for the following purposes:

  • to process, fulfil, and deliver your orders;
  • to communicate with you about your orders, account, or enquiries;
  • to process credit account applications and manage credit accounts, including conducting credit checks through credit reporting agencies;
  • to send you marketing communications, newsletters, promotions, and product updates (with your consent — see section 7);
  • to improve our website, products, and services;
  • to manage returns, refunds, and warranty claims in accordance with our Returns and Refunds Policy;
  • to comply with our legal and regulatory obligations, including under the Australian Consumer Law, taxation law, and workplace health and safety law;
  • to protect the safety, rights, and property of Elevate Survey Supplies, our customers, and the public; and
  • for any other purpose disclosed to you at the time of collection or to which you have consented.

We will not use or disclose your personal information for a purpose other than the primary purpose of collection, unless an exception under the Privacy Act applies (e.g., you have consented, it is required by law, or you would reasonably expect us to use or disclose it for a related secondary purpose).

  1. Who We May Share Information With (APP 6, APP 8)

We may disclose your personal information to:

  • Service providers: payment processors (e.g., Stripe, PayPal), courier and freight companies, IT and website hosting providers, and email marketing platforms — only to the extent necessary for them to perform services on our behalf;
  • Credit reporting agencies: for the purposes of assessing credit account applications and managing credit accounts;
  • Professional advisors: our accountants, lawyers, and insurance providers as reasonably required;
  • Legal and regulatory authorities: where required or authorised by law, including the Australian Taxation Office (ATO), the ACCC, the OAIC, or law enforcement agencies; and
  • Related entities: any related body corporate of Elevate Survey Supplies.

We will never sell your personal information to third parties.

6.1 Overseas Disclosure (APP 8)

Some of our service providers (e.g., website hosting, email platforms, analytics services) may store or process data on servers located outside Australia, including in the United States and the European Union. Before disclosing personal information overseas, we take reasonable steps to ensure that the overseas recipient handles your information consistently with the Australian Privacy Principles. By providing your personal information to us, you consent to the disclosure of your information to overseas recipients for the purposes described in this policy.

  1. Direct Marketing (APP 7)

We may send you marketing communications about our products, services, promotions, and industry news by email. We will only do so where:

  • you have consented to receive marketing communications (e.g., by subscribing to our mailing list or creating an account); or
  • you would reasonably expect to receive such communications based on your existing relationship with us (e.g., you are a customer or credit account holder), and we have provided you with a simple way to opt out.

You can opt out of marketing communications at any time by clicking the “unsubscribe” link in any email, contacting us at [email protected], or updating your account preferences. We will process your opt-out request within 5 Business Days.

Our direct marketing practices comply with the Spam Act 2003 (Cth). All marketing emails will include our identity, contact information, and a functional unsubscribe mechanism.

While we take all reasonable precautions, no method of data transmission or storage is completely secure. We cannot guarantee absolute security of your personal information.

  1. Data Retention

We retain your personal information only for as long as it is needed for the purposes for which it was collected, or as required by law. For example:

  • order and transaction records are retained for a minimum of 7 years for taxation and legal compliance purposes;
  • credit account records are retained for the duration of the account and for 7 years thereafter;
  • marketing preferences are retained until you opt out or request deletion; and
  • website analytics data is retained in aggregated, de-identified form.

When personal information is no longer required, we will take reasonable steps to destroy or de-identify it in accordance with APP 11.2.

  1. Notifiable Data Breaches

In the event of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will comply with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988. This means we will:

  • conduct a prompt assessment of the suspected breach (within 30 days);
  • notify affected individuals as soon as practicable, including a description of the breach, the type of information involved, and recommended steps to reduce harm; and
  • notify the Office of the Australian Information Commissioner (OAIC).
  1. Access and Correction (APP 12, APP 13)

You have the right to:

  • Access: request access to the personal information we hold about you. We will respond to your request within a reasonable period (generally within 30 days). There is no charge for making a request, although we may charge a reasonable fee for providing access if significant resources are required to locate and compile the information.
  • Correction: request that we correct any personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading. We will take reasonable steps to correct the information within 30 days of your request.

We may refuse access or correction in limited circumstances permitted by the Privacy Act (e.g., where access would unreasonably affect the privacy of other individuals, or where the information relates to legal proceedings). If we refuse a request, we will provide you with written reasons for the refusal and information about how to make a complaint.

To make an access or correction request, contact us at [email protected]. We may need to verify your identity before processing your request.

  1. Anonymity and Pseudonymity (APP 2)

Where practicable, you have the option of dealing with us anonymously or using a pseudonym. However, if you choose not to provide certain personal information, we may not be able to process your order, deliver products, manage your credit account, or respond to your enquiry.
